This website is directed only at professional clients and eligible counterparties as defined in the rules of the Financial Conduct Authority. By accessing it you represent and warrant that you fall within one of those categories, that you are acting in the course of your business, and that, where you access the website on behalf of another person, you are authorised to accept these terms on that person’s behalf.
The protections available to retail clients under the rules of the Financial Conduct Authority do not apply to professional clients and eligible counterparties, and you may not have the benefit of them. You may also have no right of action against SailWealth Limited under section 138D of the Financial Services and Markets Act 2000, which is available only to private persons.
Nothing on this website is directed at retail clients, and no retail client should rely on any part of it.
This website is not directed at, and is not for distribution to or use by, any person in any jurisdiction where its publication or availability would be contrary to local law or regulation, or where it would subject SailWealth Limited or Capital Systematics Ltd to any registration or licensing requirement. In particular, SailWealth Limited does not provide services to persons in the United States or to US persons, and nothing on this website constitutes an offer or solicitation to any such person. Persons who access this website from outside the United Kingdom are responsible for informing themselves of, and observing, any applicable local requirements.
The content of this website is provided for general information only. It does not constitute investment advice, a personal recommendation, legal, tax or accounting advice, a prospectus, or an offer, invitation or inducement to buy or sell any financial instrument or to engage in any investment activity. It does not take account of the investment objectives, financial situation or particular needs of any person.
This website is not published on the basis that any person will rely on it. In making it available, SailWealth Limited does not assume, and expressly disclaims, any duty of care or responsibility to any person who accesses it or who is informed of its contents. The inclusion of any manager, fund or strategy on this website is not a recommendation or an endorsement of it.
Past performance is not a reliable indicator of future results. The value of investments and any income from them may fall as well as rise, investors may not recover the amount originally invested, and movements in exchange rates may cause the value of an investment to fall or rise independently of its underlying performance. Performance shown gross of fees does not reflect the effect of commissions, fees and other charges, which will reduce returns.
Any projection, forecast, target, estimate or illustration appearing on this website is illustrative only. It is based on assumptions which may not prove correct, does not represent a promise, guarantee or reliable indicator of future performance, and actual results may differ materially. Where simulated or hypothetical performance is shown, it does not represent actual trading, is prepared with the benefit of hindsight, and is subject to the limitations inherent in any assumed set of conditions.
No representation is made that any investment objective will be achieved, that any strategy or risk management process will be successful, or that any person will achieve results comparable with any results shown.
Any market commentary, insight or other editorial material published on this website is a marketing communication. Nothing in this clause restricts anything which, by virtue of section 29A of the Copyright, Designs and Patents Act 1988, may not lawfully be restricted by contract.
SailWealth Limited expressly reserves its rights in respect of text and data mining, including for the purposes of any applicable reservation of rights regime.
If you breach this clause your right to use this website ends immediately, and you must at our option return or destroy any copies you have made and confirm to us that you have done so. We may report a suspected breach to the relevant regulators and law enforcement authorities and disclose your identity to them.
You will not use this website for any unlawful purpose, or in any way that damages or impairs it, or that interferes with any other person’s use of it.
You agree to indemnify SailWealth Limited and each Protected Person against all liabilities, claims, damages, losses, costs and expenses, including reasonable legal costs, arising out of your breach of these terms or your unlawful use of this website, save to the extent that SailWealth Limited may not lawfully exclude or limit its liability.
Each of the following paragraphs operates separately. To the fullest extent permitted by law, SailWealth Limited accepts no liability for any loss or damage arising from:
To the fullest extent permitted by law, SailWealth Limited accepts no liability for indirect or consequential loss, loss of profit, loss of anticipated savings, loss of business or business opportunity, loss of goodwill or loss of data, whether arising in contract, tort including negligence, breach of statutory duty, misrepresentation or otherwise.
If and to the extent that any exclusion in this clause is held to be unenforceable, the total aggregate liability of SailWealth Limited to you in connection with this website, however arising, is limited to one thousand pounds sterling. If any paragraph of this clause is held to be unenforceable, the remaining paragraphs continue in full force.
The exclusions and limitations in these terms apply for the benefit of SailWealth Limited and of each of its directors, officers, employees, consultants, agents and group companies, and their respective directors, officers, employees and agents, each of whom is a Protected Person, and each Protected Person may rely on them.
Nothing in these terms excludes or limits any liability which cannot lawfully be excluded or limited. In particular, nothing in these terms excludes or restricts any duty or liability that SailWealth Limited owes to a client under the regulatory system, or any liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.
Each Protected Person may enforce and rely on clauses 2.12 and 2.13 in its own right under the Contracts (Rights of Third Parties) Act 1999. Save as set out in this clause, a person who is not a party to these terms has no right under that Act to enforce any of them. These terms may be varied or withdrawn without the consent of any Protected Person.
We may amend these terms at any time by publishing a revised version on this page. The version published at the time you access the website is the version that applies. You may not assign or transfer your rights or obligations under these terms; we may do so freely. Clauses 2.3, 2.4, 2.10, 2.11, 2.12, 2.13, 2.14 and section 8 survive any cessation of your use of this website.
Each provision of these terms is severable. If any provision is held to be invalid, illegal or unenforceable, it is to be treated as modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed, and in either case the remaining provisions continue in full force. No delay or forbearance by us in exercising any right is a waiver of it, and no waiver of one breach is a waiver of any other.
Investing in financial instruments carries inherent risks, including the loss of some or all of the capital invested. The value of investments and any income derived from them may fall as well as rise, and investors may not recover the full amount originally invested. Past performance is not a reliable indicator of future results.
Returns may be affected by a variety of factors, including market volatility, economic and political developments, currency fluctuations, interest rate changes, counterparty failure and other global events. Some investment products may be illiquid, complex, leveraged, or subject to lock-up periods or restrictions on redemption, making them unsuitable for all investors. Where leverage is used, losses may exceed the amount invested.
Before making any investment decision, you should ensure that you fully understand the product features, the associated risks, and the potential impact on your portfolio, and you should read the relevant offering documentation in full. SailWealth Limited does not guarantee the performance of any investment product, strategy or third party manager. Independent financial, legal and tax advice should be sought before proceeding with any investment.
Equities. Investments in equities, particularly those in foreign or emerging markets, are subject to higher volatility, regulatory divergence, currency risk and lower liquidity. Political and economic instability can further amplify these risks.
Fixed income. Fixed income instruments are exposed to interest rate risk, credit risk, inflation, reinvestment and prepayment risk. Bond values may fluctuate in response to changes in market conditions or issuer creditworthiness.
Property. Real estate investments are generally illiquid and may experience volatility in value based on local market conditions, interest rates, economic cycles and regulatory changes. Returns are not guaranteed and may be influenced by factors beyond the investor's control.
Alternative investments. Private equity, hedge funds and other alternatives often involve leverage, derivatives, short selling, concentrated exposures, complex instruments, limited transparency and long lock-up periods. Valuations may be estimated rather than observable, and redemptions may be suspended or gated. These investments are suitable only for experienced investors capable of tolerating high risk and illiquidity.
Currency. Where an investment is denominated in a currency other than the investor's base currency, movements in exchange rates may cause the value of that investment to fall or rise independently of its underlying performance, and any hedging arrangement may be imperfect or costly.
